The Book Nook is committed to safeguarding your privacy online.  This Privacy Policy only covers information collected at the Book Nook web site (“Web Site”) (however accessed and/or used, whether via computer, electronic device, mobile device, telephone, or otherwise), and does not cover any information collected at any other web site or offline (unless specifically stated).  This Privacy Policy does not apply to entities that are not owned or controlled by us, such as other websites or applications utilizing or accessing the Web Site.  By using the Web Site, you agree to this Privacy Policy.

Information You Provide Us

We may ask you to provide us with two types of personal information: (1) information that could reasonably be used to identify you personally, such as your name, e-mail address, date of birth, cell phone number and physical address; and (2) information, such as gender, zip code, information regarding your education or number of children, and information regarding your lifestyle, hobbies, reading preferences, or other similar information ((1) and (2) above are collectively referred to as “Personal Information”). We may collect this information at various places and forms on the Web Site. You may also be asked to choose a user name and password in order to identify yourself during future visits to the Web Site, and in those cases, please do not use your real name or the name of any other actual person as your user name. Providing us with information about yourself is your choice, and you can always choose not to provide certain information, but then you may not be able to take advantage of some of the Web Site’s features.  You may also provide us with information regarding transactions or payments you make on the Web Site.  If you prefer that we do not store your payment account information, then you may request that the payment account information not be so stored.

Information from Other Sources

We may receive information about you from other sources; for example, we may receive information from a marketing partner in connection with a co-branded web site or promotion. We may use this information for a variety of purposes, including to enhance our ability to serve you and to tailor content and ads we serve to you. We may combine the information we receive from those other sources with information we collect through the Web Site. In those cases, we will apply this Privacy Policy to any Personal Information received, unless otherwise specifically disclosed by us at the time you provide your Personal Information.  We may also request that other sources, such as advertisers, provide us with information indicating how our users responded to advertisements on the Web Site in order to allow us to measure the effectiveness and quality of advertisements on the Web Site.  See below for further details on such.

Information We Collect As You Access And Use The Web Site

We may receive and store certain types of Web Site usage information whenever you visit or interact with the Web Site. For example, we and our third party service providers may collect the page served, the time, the source of the request, the type of browser making the request, the preceding page view and other similar information. We may also collect your IP address or some other unique identifier for the particular device you use to access the Internet, as applicable (collectively referred to herein as a “Device Identifier”). A Device Identifier is a number that is automatically assigned to your computer, your cell phone, or other device used to access the Internet (each, a “Device”), and our computers identify your Device by its Device Identifier. When analyzed, web site usage information helps us determine how our site is used, such as what types of visitors arrive at the Web Site, and what type of content is most popular. We may associate your Device Identifier or web site usage information with the Personal Information you provide, but we will treat the combined information as Personal Information.

Cookies

The Web Site uses standard technology called “cookies,” which are small data files that are transferred to your Device when you visit the Web Site if your browser is set to accept cookies. Cookies automatically identify your web browser to the Web Site whenever you visit the Web Site, and may make navigating and using the Web Site easier for you and allow you to personalize your experience on the Web Site. Web Beacons

The Web Site and any communications sent by the Web Site may contain electronic images (generally, single-pixel “.gif” images) called “web beacons.” These web beacons allow us and third parties to monitor and collect certain information about the viewer of the web page, web-based document, e-mail message, or other communication, such as the type of browser requesting the web beacon, the Device Identifier of the Device that the web beacon is sent to and the time the web beacon was viewed.

Embedded Scripts

An embedded script is programming code that is designed to collect information about your interactions with the Web Site, such as the links you click on. The code is temporarily downloaded onto your Device from our Web server or a third party service provider, is active only while you are connected to the Web Site, and is deactivated or deleted thereafter.

IMPORTANT NOTICE REGARDING PUBLIC AREAS OF THE WEB SITE AND USER CONTENT

If you register to join the Web Site (“Member“), you may be able to create a public profile that includes information such as your photo, username, city/state and other information that you choose to post publicly (“Profile“). The Web Site may also publicly post information about your activity on the Web Site as a Member, such as when you post information, such as a blog entry or message board post, to the Web Site.

The Web Site may contain public areas to which you can contribute your original text and audio or video content, such as comments, the message boards, blog comments areas, personal blog, online chat features, and the public portion of your Profile (collectively, “Public Areas“).If you submit comments, message board posts, blog comments, votes, reviews, suggestions, chat messages, photographs, videos, audio recordings, music, text or other content to Public Areas (“User Content“), it may be published online or offline in any media or format (currently existing or later developed). Other users of the Web Site will have access to your User Content and may have the ability to share it with third parties across the Internet, including through the use of Web Site features allowing users to share links to User Content with third party web sites (such as Blogger, Facebook, Twitter and similar sites). We may use your User Content, or any portion, for advertising, marketing, publicity, promotional, and other business activities. If you submit any User Content including comments, message board posts, blog comments, votes, reviews, suggestions, chat messages, photographs, or videos, such may be published online or offline (including, without limitation, on the Book Nook, on a CD or DVD, or any other electronic or non-electronic media or format currently existing or later developed). We may publish your name, voice, likeness and other Personal Information in connection with publishing the User Content or any thereof, and we may use the User Content and any excerpt thereof in connection with advertising, marketing, publicity, promotional and other business activities. 

You also may have the ability to interact and communicate with other Members on the Site. Please use caution when interacting and communicating with people that you do not know personally. Please note that we cannot ensure the security of any information you choose to make public and cannot ensure that parties who have access to such publicly available information will respect your privacy. Therefore, use caution when including Personal Information in User Content or a Public Area or any message that you send using the Web Site (for example, do not post your real name, e-mail address, phone number or physical address).  Furthermore, when you access other web sites, by clicking on links on our Web Site, we are not responsible or liable, in any way, for the privacy policies, or lack thereof, of other web sites.  You are strongly encourage to read the privacy policies of all web sites you visit.

HOW WE USE THE INFORMATION COLLECTED

We may use information collected through the Web Site, including your Personal Information: (1) to process your registration with the Web Site, including verifying that the information provided is active and valid; (2) to provide you with information or services or process transactions that you have requested or agreed to receive; (3) to allow you to participate in the Public Areas and other features of the Web Site; (4) to improve the Web Site or our services and for internal business purposes; (5) for purposes disclosed at the time you provide your Personal Information; (6) to send you promotional materials and share your information with third parties so that these third parties can send you promotional materials; (7)  to send you communications either about your account with us or about our Web site; and (8) to share such information with our affiliates and third parties that offer products and/or services under brand names or using characters or other intellectual property of the Web Site or us; (9) to share such information with our affiliates and third parties for advertising, marketing, publicity, promotional,  and other business purposes.  You will have the opportunity to opt out or block out our sharing of your Personal Information with others at the point of submission of your Personal Information or at any other time by written request.  

If you send a friend a communication from the Web Site, the information you provide (names, e-mail addresses, etc.) is used on a one-time basis to facilitate the communication and is not used for any other marketing purpose, unless we obtain consent from that person.

We may also take your Personal Information and make it non-personally identifiable, either by combining it with information about other individuals or by removing characteristics (such as your name) that make the information personally identifiable to you de-personalizing your information. Given the nature of this information, there are no restrictions under this Privacy Policy upon our right to aggregate or de-personalize your Personal Information, and we may use and/or share with third parties the resulting non-personally identifiable information in any way.    Your Personal Information may also be shared with a prospective purchaser who is seeking to purchase any of our assets , including, but not limited to, the Personal Information provided by Users of the Web Site, or to acquire an ownership interest in us or the Web Site.

THIRD-PARTY AD SERVING AND AUDIENCE AND TRAFFIC MEASUREMENT SERVICES

The Web Site may use third party network advertisers to serve advertisements on the Web Site and may use a traffic measurement service to analyze traffic on the Web Site. Network advertisers are third parties that display advertisements based on your visits to the Web Site and other web sites you have visited. Third-party ad serving enables us to target advertisements to you for products and services in which you might be interested. Although advertisers and other companies do not have access to cookies set by the Web Site, the Web Site’s third party ad network providers, the advertisers, the sponsors, and/or traffic measurement services may themselves set and access their own cookies on your Device if you choose to have cookies enabled in your browser or they may otherwise have access to non-personal information. These third party cookies are set to, among other things, help deliver advertisements to you that you might be interested in, to prevent you from seeing the same advertisements too many times and to conduct research regarding the usefulness of certain advertisements to you. Note that any images (or any other parts of a web page) served by third parties in association with third party cookies may serve as web beacons, which enable third parties to carry out the previously described activities. Third party cookies and web beacons are governed by each third party’s specific privacy policy, not this one.

WITH WHOM INFORMATION MAY BE SHARED

We may share your Personal Information with affiliates and third parties for those affiliates and third parties’ advertising, marketing, publicity, promotional,  and other business purposes, unless you opt-out to such sharing at the point of submission of your Personal Information or at any other time by written request. We may also share non-personal information, such as aggregate user statistics, demographic information, and web site usage information with third parties. In addition, we may share your information as disclosed at the time you provide your information, as set forth in this Privacy Policy and in the following circumstances:

Third parties providing services on our behalf

We employ third parties to perform functions on our behalf; examples include hosting or operating the Web Site, sending e-mail and/or other communications, providing wireless services, removing repetitive information from customer lists, data analysis, marketing assistance, and customer service. These third parties may have access to your Personal Information for the purpose of performing such functions on the Web Site’s behalf.

Receiving Information From Third Parties

You may be presented with an opportunity to receive information and/or marketing offers from third party(s). If your Personal Information is shared with any affiliate or  third party, then you will be subject to the privacy policy and practices of such affiliate or third party. We are not responsible or liable, in any way, for the privacy policies and practices of such affiliates or third parties and, therefore, you should review the privacy policies and practices of such. If you later decide that you no longer want to receive communication from a third party, you will need to contact that third party directly.

Sweepstakes, Contests and Promotions

We may offer sweepstakes, contests, and other promotions (“Promotion”) through the Web Site that may require registration. If you choose to enter a Promotion, your Personal Information may be disclosed to third parties in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law, such as on a winners' list. Also, by entering a Promotion, you are agreeing to the official rules that govern that Promotion, which may contain specific requirements of you, including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice and/or likeness in advertising or marketing associated with the Promotion.

Business Transfers

We may share your Personal Information with other entities affiliated with us for internal reasons, such as for business and operational purposes.  We or any of our assets, including, but not limited to the Web Site, may be sold, or other transactions may occur in which your Personal Information is one of the business assets for the transaction. In such a case, your Personal Information may be one of the business assets we transfer. Hence, we reserve the right to disclose and transfer user information, including Personal Information (i) to an affiliate or third party, (ii) to a subsequent owner, co-owner or operator of the Web Site or applicable database, or (iii) in connection with a corporate transaction, including, but not limited to, a merger, consolidation, restructuring, the sale of all or any portion of our stock and/or assets, or other corporate transaction including, without limitation, during the course of any due diligence process.

Legal Protections and Law Enforcement

We may disclose information about our users, including your Personal Information, in the event we are required to respond to subpoenas, court orders, legal process or other valid law enforcement measures; to comply with a legal obligation; at the request of governmental authorities conducting an investigation; to verify or enforce compliance with the policies governing the Web Site and applicable laws; or to protect the legal rights, interests, or safety of the Web Site, our users or others. We may also use Device Identifiers, including IP addresses, to identify users, and may do so in cooperation with copyright owners, internet service providers, wireless service providers or law enforcement agencies in our discretion. When You Make a Payment

When you make a payment through our Web Site, you provide us with certain information to assist in the processing of such payments.  We share such information with those third parties necessary to complete the transaction.

 

UPDATING YOUR INFORMATION; OPTING OUT FROM EMAIL COMMUNICATIONS; DELETING YOUR ACCOUNT

The Web Site may contain web pages through which you can correct or update some of the personal information you have provided to us through registration with the Web Site. With regard to e-mail newsletters and similar communications you may receive from us, you may tell us you no longer want to receive these emails from the Web Site by following the opt-out instructions provided to you in those communications. Please note that we reserve the right to send you certain communications relating to your account or use of the Web Site, such as administrative and services announcements and these transactional account messages may be unaffected if you choose to opt-out from marketing communications.  In the event you want to stop using your account, you may request that we delete or deactivate your account.  Deactivating your account will allow you to reactivate your account, upon our approval, as opposed to deleting your account, which will permanently delete your account from the Web Site.  You should only delete your account if you never will want to reactivate your account.  If you delete or deactivate your account, your information may still be viewable to the extent that you have shared your information with others.

THIRD PARTY CONTENT AND LINKS TO OTHER WEB SITES

When you are on the Web Site you may be directed to other sites that are operated and controlled by third parties that are beyond our control. For example, if you “click” on a banner advertisement, the “click” may take you off the Web Site onto a different web site. This includes, but is not limited to, links from advertisers, sponsors and partners that may use the Web Site’s logo as part of a co-branding agreement. These other web sites may set their own cookies on your browser, independently collect data or solicit Personal Information and may or may not have their own published privacy policies. If you visit a web site that is linked from our Web Site, we strongly encourage you to consult that web site’s privacy policy before providing any Personal Information.  We are not responsible or liable, in any way, for the privacy practices employed by any third party or other web site.

CONSENT TO TRANSFER

The Web Site is operated in the United States. If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that information we collect will be transferred to and processed in the United States. By using the Web Site or providing us with any information, you consent to this transfer, processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

SECURITY

We incorporate commercially reasonable safeguards to help protect and secure your Personal Information. However, no data transmission over the Internet, or wireless transmission, or electronic storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you submit via the Web Site, and you do so at your own risk.  Please report any suspected security violations to us through our Web Site.

 

A SPECIAL NOTE FOR PARENTS CONCERNING PRIVACY

The Web Site is a general audience web site. We do not knowingly collect any Personal Information from children younger than the age of thirteen (13) on the Web Site and we will delete any information later determined to be from a user younger than thirteen (13).

NOTIFICATION OF CHANGES 

From time to time, we may update this Privacy Policy and those changes will become effective immediately upon posting.
